4. Evaluation of the extent of approximation
In this column the relevant national entities evaluate the extent of approx-
imation such as “fully approximated”, “partially approximated” or “not
approximated” This evaluation expresses the extent of approximation of
each of the provisions of the national legal act with the relevant provision
of the EU legal acts. This means that if the content of the provision of
the national act identically regulates the issue as the provision of the EU
legal act that is transposed, “fully approximated” extent is to be quoted.
However, it should be taken into consideration that even though the
provisions indicated in the Correlation Table obtained fully approxi-
mated extent, it does not mean the evaluation in the Statement on the
Approximation of the national legal act with the relevant EU legal act
are fully in conformity, since it would mean that each of the provisions
of the EU legal act is transposed in the national legal act and that no
deviation exist as to how this matter is regulated in those two acts, ex-
cept where the provisions of the EU legal act allow different national
regulation of the issues covered by that provision.
The evaluation “partially approximated” means that the content of the
relevant provision of the EU legal act is only partially transposed in
the national legal act and it implies that the provision of the national
legal act contains, or regulates more matters than are regulated by the
EU legal act, and no permission exist, or that it fails to regulate the
matter that is regulated by the provision of the EU legal act.
The evaluation “not approximated’ would mean that the content of the
provision of the national legal act does not comply with the content of
the provision of the EU legal act, or it is regulated completely different
and possibly even opposite.
In our legislation nowadays, where provision of national legal act is
in question in which the relevant provision of the EU legal act is not
transposed it is not indicated in the Correlation Table, and it means that
even though certain provisions quoted in the Correlation Table are fully
approximated with the provisions of the EU legal act, the evaluation in
the Statement on the Approximation will be “partially approximated”.
