reference is made to technical data of the directive striving
for uniÞcation of technical standards in certain areas. Even in
those cases completely transposed provisions of directives in a
national legal system should be ensured in such a way;
• To guarantee clear and applicably regulated area to the entities
it is addressed. This approach should be avoided when direc-
tives amended a number of times are transposed, making al-
most impossible to clearly deÞne the valid text of the directive.
Nevertheless, this approach is not permitted or recommended
where the directive directly regulates the rights and obligations
of natural and legal persons in the Member States;
• Transposition of annexes to the EU acts in national legal acts
usually means application of a technique necessary to deter-
mine whether those annexes have a normative part, which is
to be transposed in the material part of the national legal act.
In the case where technical part that includes certain formulas,
lists, tables, forms and etc. is in question, this type of annexes
is transposed separately attached to the national legal act, and
bylaws are principally concerned here since laws in the nation-
al legislation, as a rule, do not include annexes.
6. DECISIONS
A decision shall be binding in its entirety for all it is addressed. It is
individual legal act in which entities are speciÞcally deÞned (a state,
several states, natural person, legal person). Same rules apply as for
regulations – following their content in details it is necessary to ensure
whether and what measures are to be taken on national level and sub-
sequently to prepare appropriate legal acts and make possible entire
direct application of the decision in a national legal system.
7. OTHER EU LEGAL ACTS
1. Within the Second Pillar of the European Union, Article 12 of the
Treaty provides that the Council in exercising its competences shall
deÞne common strategies, common positions and common actions.
Common strategies – these documents deÞne the objectives, time limit
and assets in the areas in which Member States have important com-
