effect pending the accession of the Republic of Macedonia in the Eu-
ropean Union. To be precise, in the case where in certain provisions
referred to in a legal act (law, decree, decision, rulebook and etc.) EU
regulation has been transposed, separate article should provide, placed
above the provision related to entering into force of that legal act, that
those provisions will have effect pending the accession of the Repub-
lic of Macedonia in the European Union. For instance,

“Article 38
The provisions referred to in Articles 20, 25 and 30 of this Rulebook
shall have effect pending the accession of the Republic of Macedonia
in the European Union.”

Provided that the EU regulation has been transposed in all provisions
of the legal act (law, decree, decision, rulebook and etc.), special arti-
cle, placed above the Þnal provision thereof, shall provide that the le-
gal act shall cease to have effect pending the accession of the Republic
of Macedonia in the European Union. For instance,

“Article 50

This Law shall cease to have effect with the accession of the Republic
of Macedonia in the European Union.”

One extraordinary example of the method of incorporating regulations in
the national legislation is through ratiÞcation of conventions in the avi-
ation area according to which reference is made only to application of
relevant regulations adopted in the European Union, and by ratiÞcation of
the given convention it becomes part of the legal system of the Republic
of Macedonia, and for the purpose of observance and implementation of
the convention reference is made to EU regulations or acts that are to be
applied in the Republic of Macedonia in accordance with the convention.
The Constitutional Court of the Republic of Macedonia provided approv-
al for establishing this novelty on Initiative for evaluation of the constitu-
tionality of Article 3 of the Aviation Law by taking decision on non-insti-
gating procedure for evaluation of constitutionality of this Article.

Another example in the Þeld of aviation, which is also an exception from
the implementation rule of the regulations in the national legal system,
represents a direct incorporation of the regulations in the national by-
