approximated, when box 3.2., and the other boxes in the Statement
are completed, depending on the fact whether secondary source of the
EU law in question has binding or nonbinding nature, and whether
correlation table is necessary; so that in case of secondary source of
legislation that has binding nature, opinion of the Secretariat for Leg-
islation include items 2 and 3 for which Correlation Table exists.
In the case where in addition to the provisions of the Stabilisation and
Association Agreement, the national legal act is approximated with
other sources of the EU law falling under box 3.3. or 3.4., for which
correlation table is not drafted, in box a) it is stated that the full ap-
proval of the Secretariat for Legislation refers to point 2 and point
3.3., or 3.4. of the Statement on the Approximation. In the case where
the national legal act is not subject to approximation with an EU legal
act and it is lacking EPP number and accordingly no Statement on the
Approximation and Correlation Table are drafted, the Secretariat for
Legislation does not provide any opinion.
The Opinion of the Secretariat for Legislation is submitted to the sectoral
ministry that has drafted the bylaw, prior to its publication in the OfÞcial
Gazette of the Republic of Macedonia. If legal act of the Government of
the Republic of Macedonia is in question, the Opinion of the Secretariat
for legislation is submitted to the Government of the Republic of Mace-
donia, and if law is in question that has passed governmental procedure,
it is delivered to the Assembly of the Republic of Macedonia together
with the Statement on the Approximation and the Correlation Tables.

This Handbook is a tool to serve all entities included in the process of
approximation of the legislation of the Republic of Macedonia with
the European Union legislation and we hope that it will ensure uni-
form action of all entities in this process, and interim it will consti-
tute basis of the already deÞned practice and knowledge to build new
mechanisms and instruments as well as to improve the existing in line
with what is imposed by everyday process, in order to successfully
complete the task of approximation and adoption of the Acquis Com-
munautaire in the national legislation of the Republic of Macedonia as
one of the criteria for the European Union membership.
